The College of Law in conjunction with the Society of Notaries of New South Wales, is authorised to conduct training for barristers or solicitors of not fewer than five (5) years standing, who wish to apply for appointment as a Public Notary under the Public Notaries Act 1997 (NSW).  Successful completion of this course will enable you to apply to the Legal Profession Admissions Board (LPAB) for appointment by the Supreme Court of NSW as a Public Notary and thereafter perform common Notarial functions including:

  • Authenticating official, government and personal documents and information for use overseas.
  • Witnessing signatures of individuals to documents and authenticating identity for use overseas.
  • Witnessing Powers of Attorney for use overseas, including from time to time, preparing them.
  • Certifying true copies of documents for use overseas.
  • For corporations and business -witnessing documents and authenticating status and transactions for use overseas.
  • Dealing with documentation for land, property and deceased estates overseas.

Please note this important information:

  • Before enrolling in this course, please read the Legal Profession Admission Board’s ‘Guide for Applicants for Appointment as a Public Notary,’ which is available here. If you are in any doubt as to your eligibility to be appointed as a Notary, you should contact the LPAB prior to enrolment.
  • For further information regarding the work of a Notary and recommended fees for performing notarial work, please refer to the Society of Notaries website.
  • Section 11 of the Public Notaries Act 1997 (NSW) restricts public notaries who are not part of a law practice (for example, in-house counsel) from performing notarial work for their employer or a client of their employer.
  • The Notarial Practice Training Course is a very challenging course of study. You should not enrol unless you can devote ample time to attend the training, review the materials and complete the assessment. In past intakes, not all participants have achieved the required standard in the assessment.
  • If you enrol in this course and then subsequently withdraw prior to commencement, you will not be permitted to automatically transfer to a future course and withdrawal fees may apply.

  • Your enrolment and place in the course are not secured until payment is made. COURSE STRUCTURE

The course is comprised of a three-day face-to-face training component, followed by a take-home examination assessment. The course will be conducted by members of the Society of Notaries of NSW, including:

  • Peter Snelgrove, Member and Past President;
  • Colin Dunston, Secretary and Treasurer; and
  • Justin Betar, Member and Immediate Past President.

Assessment:

To successfully complete this course and thereafter be eligible to apply for appointment as a Notary, participants must:

  • attend and participate in all sessions of the training course; and
  • achieve a grade of 75% in each section of the take-home examination.

Attendance and participation

  • Participants must attend all sessions of the training course and follow the reasonable directions of the course facilitators. Strict compliance with the attendance requirements is a condition of successful completion of this course.
  • Activities that relate to work or personal commitments (including phone calls, emailing etc) may only be undertaken during the scheduled breaks and not during sessions.
  • Any participant that misses more than 15 minutes of a session without the prior authorisation of the course facilitators shall be at risk of failing the course and such authorisation shall only be granted in extenuating circumstances relating to ill health, emergency or serious misadventure.

Take-home examination

  • The hardcopy examination paper will be distributed to participants at the conclusion of the training course.
  • Participants will have 14 days to complete and return the take-home examination to the College.
  • The exam will consist of five sections, including both multiple choice and written answers of varying lengths to exam questions and drafting Notarial Certificates.
  • To achieve a passing mark in the examination and successfully complete the course, participants must achieve 75% or better in each and all of the 5 sections of the exam.

Extensions to complete the examination will only be granted in extenuating circumstances related to ill health, emergency or serious misadventure. Work commitments (unexpected or otherwise) will not constitute extenuating circumstances.

This course is approved for NSW Practitioners only.

If you hold a practising certificate in a state or territory other than Western Australia and this educational activity extends your knowledge and skills in areas that are relevant to your practice needs or professional development, then you should claim one (1) "unit” for each hour of attendance, refreshment breaks not included. The annual requirement is ten (10) CPD units each year from 1 April to 31 March. Some practitioners, such as accredited specialists are required to complete more than ten (10) units each CPD year.
